Terms and conditions
If you do not agree to these Terms and Conditions, do not continue or add your Card to a Mobile Wallet Service (“Wallet”, “Service”), including but not limited to Apple Pay®, Samsung Pay®, and Android Pay®.If a mobile application’s terms and conditions conflict with your applicable WEOKIE Account Agreement(s), the WEOKIE Account Agreement will govern the transactions posted to your WEOKIE account (“Account(s)”).Nothing in this Terms and Conditions is intended to supersede, replace or otherwise modify any cardholder or account agreement or any other agreement you may have with WEOKIE Federal Credit Union (“WEOKIE”).
The Service allows you to add your WEOKIE Debit or Credit Card (“Card(s)”) to an application (“App”) using your mobile device. You agree that you are an authorized user of the mobile device that you will use to access the Wallet. Only the cardholder whose name is embossed on the Card should enter account information. Once added, you understand that you may use your mobile device to make payments only where the Wallet is accepted. WOKIE is not a provider of the Wallet and is not responsible for any failure or inability to perform a transaction using the Wallet. WEOKIE is only responsible for supplying information securely to the Wallet provider to allow usage of the Card in the Wallet.
Security:
You are responsible for keeping your login and credentials private and secure. After enrolling in a Mobile Payment System (ie. Apple Pay®, Samsung Pay®, Android Pay®, Softcard®, etc.) you agree to secure your mobile device with the same care you would your Card(s) in order to avoid unauthorized use of your Account(s). You understand that by enabling a Mobile Payment System to use your mobile device to make purchases and other transactions using your Account(s), your mobile device in certain instances will act as if it were your Card(s). If your mobile device is lost or stolen, or your login and credentials are compromised, you agree to immediately notify the Mobile Payment System provider and WEOKIE.WEOKIE is not responsible for the security of information provided to App parties or stored in a Wallet. WEOKIE is not responsible if there is a security breach affecting any information stored in any Wallet or sent from a Wallet.
Transactions:
WEOKIE reserves the right to refuse any transaction for any reason. You agree to not use your WEOKIE Card(s) or the Wallet to commit fraud or perform any illegal activities. You agree to comply with all applicable laws, rules and regulations, not just the ones in connection with your WEOKIE Card(s).
Privacy:
The use of a Wallet involves the electronic transmission of personal information through third-party connections. WEOKIE will disclose information to third-parties about your Card as necessary to add and enable your Card(s) to operate for mobile payments and to facilitate transactions you initiate using a Wallet. You understand and acknowledge that information that is provided to or held by any Wallet service or third-parties in relation to a Wallet is outside the control of WEOKIE. Refer to WEOKIE’s Privacy Policy for complete information. You should refer to the selected Mobile Payment System for its privacy practices.
E-Mail:
By enrolling in the Service you agree to receive electronic communications and notices from WEOKIE in connection with your Card(s) and the Wallet by email or on your mobile device. You agree WEOKIE can contact you by email at any email address you provide in connection with your Service enrollment or any WEOKIE account. Notices may also be provided to you by posting the material on WEOKIE’s website (www.weokie.org), by calling you at the telephone number you provided to WEOKIE, or by contacting you at the current address that is on file for you. You further agree to update your contact information with WEOKIE when it changes.
Fees:
You are responsible for any fees charged by a third-party, such as your telecommunications provider, payment instrument, merchant or any other third-party in connection with your use of the Service. WEOKIE reserves the right to institute charges for Account access or for additional transaction or features in the future, but only after written and/or electronic notification to you in advance of the date such charges will take effect.
Change to Terms:
Except as otherwise required by law, WEOKIE may in its sole discretion change these terms, and modify or cancel the eligibility to use the Service at any time, without notice. Your continued use of the Service will indicate your acknowledgment of, and intent to be bound by, any modifications made subsequent to your initial acceptance of the Terms and Conditions.
Non-Endorsement:
WEOKIE does not represent or endorse and shall not be responsible for:
- The reliability or performance of any seller, merchant or third-party provider;
- The safety, quality, accuracy, reliability, integrity or legality of any product, offer, loyalty program, or other items that may be stored, redeemed, and/or utilized as part of any process related to the Service;
- The truth or accuracy of the description of any product, or of any advice, opinion, offer, proposal, statement, data or other information (collectively, “Content”) displayed or distributed, purchased or paid for through the use of the tools in the Service;
- The availability, integrity, or security of any third-party service utilizing capabilities based on the Service.
Termination of Access:
WEOKIE may, at any time, suspend your access to the App, digital cards, or any components thereof, at its discretion. You must uninstall the App if you transfer your device to someone else.
Severability:
If any provision of the Terms and Conditions is held to be illegal, invalid, or unenforceable by a competent court, then the provision shall be performed and enforced to the maximum extent permitted by law, and the remaining provision of the Terms and Conditions shall continue to remain in full force and effect. A determination that any provision of the Terms and Conditions is unenforceable or invalid shall not render any other provision of the Terms and Conditions unenforceable or invalid.
Governing Law:
You understand and agree that the Terms and Conditions for the Service and all questions relating to its validity, interpretation, performance and enforcement shall be governed by and construed in accordance with the internal laws of the State of Oklahoma. You also agree to submit to the personal jurisdiction of the courts of the State of Oklahoma
.Warranty:
THE SERVICE IS PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEOKIE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, TITLE, QUALITY, AND NONINFRINGEMENT. WEOKIE EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND WITH RESPECT TO THE SERVICE, INCLUDING WITH RESPECT TO THE ACCURACY OR FUNCTIONALITY OF THE SERVICE, OR THE ACCURACY, VALIDITY, OR COMPLETENESS OF ANY INFORMATION AVAILABLE THROUGH THE SERVICE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE WALLET IS OBTAINED AT YOUR OWN DISCRETION AND RISK, AND WEOKIE IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL, WHETHER DUE TO ANY COMPUTER VIRUS OR OTHERWISE.
